You may not use the Services in any manner that could damage, disable, overburden, or impair any Kwegg server, or the network(s) connected to any Kwegg server.
4. Payment
You agree to pay the applicable fees for the Services you receive. All payments will be made in accordance with the payment terms provided.
5. Content
You acknowledge that Kwegg does not pre-screen content, but that Kwegg and its designees will have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Services. Kwegg shall have no responsibility or liability for the deletion or failure to store any content.
6. Proprietary Rights
You acknowledge and agree that Kwegg and its licensors own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services. You agree not to (a) modify, adapt or hack the Services; (b) copy, reproduce, distribute, display, transmit or otherwise exploit any content from the Services without the express written consent of Kwegg; or (c) sell, rent, lease, loan, transfer or otherwise provide access to the Services.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. KWEGG EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
8. Limitation of Liability
IN NO EVENT SHALL KWEGG, ITS AFFILIATES, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICES, WITH THE DELAY OR INABILITY TO USE THE SERVICES OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SERVICES, OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF KWEGG OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
9. Indemnification
You agree to indemnify, defend and hold harmless Kwegg, its affiliates, directors, employees and agents from and against any and all loss, cost, expenses, liability and damage of any kind, including, without limitation, attorneys’ fees, arising or resulting from your use of the Services, your violation of these Terms, or your violation of any rights of another.
10. Governing Law
These Terms and any action related thereto will be governed by the laws of India without regard to or application of its conflict of law provisions or your state or country of residence.
11. Refunds and Cancellations
In the event that Kwegg fails to deliver the services promised in the subscription and the user is unable to use the platform as expected, the user may contact Kwegg within 15 days of the purchase and request a refund. Kwegg will review the case and if found valid, a refund will be issued. Kwegg reserves the right to cancel any subscription at any time and issue a refund for any unused portion of the subscription. Kwegg reserves the right to change or modify the terms and conditions of the subscription at any time without prior notice.
12. General
These Terms constitute the entire and exclusive agreement between Kwegg and you regarding the Services, and these Terms supersede and replace any prior agreements between Kwegg and you regarding the Services. The failure of Kwegg to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
13. Generated Content Liability
Kwegg uses advanced technology, such as GPT, to generate content on our platform. Although we use state-of-the-art tools to produce high-quality content, we cannot guarantee the accuracy or completeness of any content generated by our technology. It is the responsibility of the user to review and verify any content before publishing it on our platform. By using Kwegg, you acknowledge and agree that any content generated by our technology is for informational purposes only and should not be considered as legal or professional advice. Kwegg assumes no liability for any errors or omissions in any content generated by our technology, and you agree to hold Kwegg harmless from any claims, damages, or losses resulting from your use of our platform.
